Federal Rescheduling Status

Cannabis remains a Schedule I substance under the Controlled Substances Act. In August 2023, HHS recommended rescheduling to Schedule III. The DEA published a proposed rule in May 2024, and President Trump signed an executive order on December 18, 2025 directing the Attorney General to expedite the process. However, the administrative hearing remains suspended pending legal challenges. Rescheduling has not been finalized.
